Terms of Service

These Terms of Service ("Terms") govern your use of The Stock Scallywag Scanner (the "Service"), operated by Stock Scallywags LLC ("we," "us," or "the Company"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

The Service is an informational and educational stock-scanning tool. It surfaces technical setups and may present general, non-personalized "considerations" based on market data and, if you connect a brokerage, your holdings. The Service does not execute trades.

2. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for keeping your login credentials confidential and for all activity under your account. Provide accurate information and keep it up to date.

3. Subscriptions and billing

• The Pro plan is currently $79 per month, billed in advance on a recurring monthly basis through our payment processor, Stripe. Current pricing is always shown on our pricing page.
• New subscriptions include a 14-day free trial. A payment method is collected up front, and the trial converts to a paid subscription and your card is charged when the trial ends unless you cancel first.
• We may offer promotional or community discount codes (for example, partner-community rates such as $30/month). Discounts are subject to eligibility, apply only while the underlying promotion remains active on your subscription, and may be modified or discontinued for new signups at any time.
• Price changes. We may change subscription prices from time to time. If a price change affects your existing subscription, we will give you advance notice (by email or in-app notice), and the new price will take effect at your next renewal — you will never be charged a new price mid-cycle. If you do not agree to the new price, you may cancel before the renewal takes effect. Continued use of the Service after the new price takes effect constitutes acceptance.
• You can cancel at any time; cancellation stops future renewals and takes effect at the end of the current billing period.
• Except where required by law, payments are non-refundable.

4. Brokerage connections

If you link a brokerage account through our third-party provider (SnapTrade), you authorize us to receive read-only account information to power the Service. Your relationship with your broker is governed by that broker's own agreements. We are not a broker-dealer, investment adviser, or financial institution.

5. Acceptable use

You agree not to misuse the Service, including by attempting to disrupt or compromise it, accessing it through unauthorized means, scraping or reselling data, or using it for any unlawful purpose.

6. Intellectual property

The Service, including its content, design, and software, is owned by the Company and protected by applicable laws. We grant you a limited, non-exclusive, non-transferable right to use the Service for your personal, non-commercial purposes.

7. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including accuracy, completeness, merchantability, or fitness for a particular purpose. Market data may be delayed, incomplete, or inaccurate.

8. Limitation of liability

To the maximum extent permitted by law, the Company will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or trading losses, arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid us in the twelve months before the claim.

9. Termination

We may suspend or terminate your access if you violate these Terms or to protect the Service. You may stop using the Service and close your account at any time.

10. Changes to these Terms

We may update these Terms from time to time. We will revise the "Last updated" date above, and continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

11. Governing law

These Terms are governed by the laws of the United States and the state in which the Company is organized, without regard to conflict-of-law principles.
